The United States calls, again, for a USMCA panel against Canada over milk quotas

For the second time, the Office of the United States Trade Representative (USTR) has requested the creation of a new dispute settlement panel against Canada under the USMCA by the allocation measures of rights dairy product prices.

The US government has assured that Canada continues to violate the commitments and obligations of the Treaty between Mexico, the United States and Canada (T-MEC), as it imposes new conditions on retailers, food service operators, among other US dairy importers.

It is therefore difficult for American dairy products to be imported into Canada because the quotas with tariff preferences are not allocated as requested by the first panel which decided in favor of the United States.

In this regard, the head of the USTR, Katherine Tai, said: “despite the fact that the United States won the previous dairy dispute panel with Canada over tariff quota allocation policies, the revised measures of the Canadian government are not solving the problem… With this request for the establishment of a panel, we are using all the tools available to enforce the trade agreements.

It should be recalled that in May 2021, the United States government requested the creation of a panel to examine the same question of the allocation of milk quotas with preferential tariffs, and although the decision was made in December of that year, it was made public until January 2022. ., but for the USTR, what the panelists asked for was not met, despite the fact that Canada changed its policies quota allocation.

In addition to said panel, there are other consultations, which are the preliminary step to a panel, which are continuing, for example, concerning Mexican energy policy, environmental issues related to the protection in Mexico of vaquita and totoaba fish . .

In addition to the fact that a US claim is currently pending under the Labor Rapid Response Mechanism against the company Manufacturas VU – which operates in Mexico – for denial of labor rights to workers.
