The allocation of seats to fifteen deputies in the National Assembly and six from foreign constituencies, elected by ballot early elections of the first and second rounds on August 20 and October 15respectively, is firm and the National Electoral Council (CNE) will prepare to close the electoral period with the delivery of credentials.

On November 8 at midnight, the three-day legal deadline granted to candidates and political groups to present their subjective contentious appeals against the allocation of seats to national and foreign deputies made by the National Electoral Council on November 5 ended.

The inauguration date of President-elect Daniel Noboa has not yet been defined and could be subject to change.

This newspaper learned that, until yesterday at 11:59 p.m., political subjects had not presented legal appeals to the Electoral Disputes Tribunal (TCE) against the definitive proclamation of the numerical results of the elections adopted by the CNE, as well as the distribution of seats, they are therefore firm.

The TCE would have even certified to the Electoral Council that its headquarters There was no appeal against the resolution allocating the seats.

Indeed, the Code of Democracy provides in its article 137 that a subjective contentious electoral appeal may be filed for the allocation of seats during multi-member elections within a period of three days from the notification of the results, and the appeal will only relate to the mathematical calculation of the award, but not the result of the careful examination.

It was on November 5, 2023 that the National Electoral Council certified that no appeal had been presented at the administrative and jurisdictional level against the numerical results of the second round of the elections of October 15 and proceeded to award the dignity of president and vice-president of the Republic to the DNA alliance duo, lists 4-35, composed of Daniel Noboa Azín and Verónica Abad Rojas.

He also proclaimed the final results of the election of members of the National and Foreign Assembly, after the nullity of the telematic vote for Ecuadorian migrants was declared and the day was repeated in person in the second round.

Once the deadlines have passed, the CNE will begin with the issuance of credentials which accredit them as elected authorities.

In addition to the 16 members of the assembly elected by the province of Pichincha, the powers have been handed over for a few days to the authorities of the 23 provinces to advance the administrative procedures for their possession in the National Assembly.

While the credentials of President Daniel Noboa and his running mate Verónica Abad will be presented on November 15 at the National Sucre Theater in Quito.

Both events are scheduled for 10:00 a.m.

Once this electoral phase within the CNE is completed, the plenary session of the legislative body will decide on the date of holding its inaugural session and will elect its internal authorities.

He will then have to summon the president-elect, Daniel Noboa, to take office and begin his duties for the next 18 months.

The law on Legislative Function and the Code of Democracy establish that “in the event of early elections, the possession of the respective positions cannot take place more than fifteen days from the proclamation of the results”. (YO)
