Federal records indicate that DePape entered the United States as a visitor on March 8, 2008 through the San Ysidro, California port of entry, which connects San Diego County to Tijuana, Mexico.

Canadian citizens generally do not need a visa when entering the United States as visitors or on business, and are permitted to stay in the country for up to six months.

“Immigration and Customs Enforcement (ICE) has requested an immigration officer from the San Francisco County Jail for Canadian citizen David DePape following his arrest on October 28,” a message from Justice Department officials read. and Homeland Security (DHS).

ICE issues so-called immigration “detainees” to federal, state and local law enforcement agencies to notify them that it will seek custody of an individual and requests that ICE be notified when this no one will be released.

If convicted of the assault, in which Paul Pelosi, 82, suffered a fractured skull, DePape, 42, could be deported once his trial in the United States is over.

DePape, charged with assault and attempted kidnapping, pleaded not guilty on Tuesday to the charges against him.

The first charge carries a maximum sentence of 30 years in prison, while that of attempted kidnapping can carry up to 20 years because the victim is a relative of a government official, according to the Ministry of Justice .
