The presidential proposal that reached the Chamber of Deputies today modifies the “exorbitant” sanctions that exist for candidates who do not respect the electoral rules, so that their candidacies are not canceled.
“Compared to the sanctions that have been imposed in the event of cancellation of candidacies, this type of exorbitant and disproportionate sanctions is modified for breaches of electoral obligations with loss of rights and even with cancellation of candidacy. Changes are proposed in the penalties to make them proportionate and fair to the conduct actually committed, safeguarding the objectives of transparency and fairness of the contest,” the initiative states.

This measure is part of the reform of the General Law on Electoral Institutions and Procedures and establishes that aspirants, pre-candidates or candidates for popular electoral office who do not submit their quarterly or annual pre-campaign or campaign reports will be sanctioned a public reprimand or a fine of up to 5,000 UMA (481,000 pesos in 2022).
In other words, the reform removes a paragraph from article 456 of the said law, which currently provides that candidates, pre-candidates and candidates who do not submit their reports will be sanctioned by the loss of the right of the offending pre-candidate to be registered as a candidate or, in their case, if already registered, to its cancellation.
