A Haitian asylum-seeking family rushed across the northern border before the US and Canada took further immigration action

(CNN) — A Haitian immigrant family on Friday became one of the latest to benefit from a loophole in a decades-old asylum deal, a day after US President Joe Biden and Canadian Prime Minister Justin Trudeau , will jointly announce changes to the treaty that restricts the entry of certain immigrants seeking protection in Canada.

the haitian family was seen in video captured overnight by CNN affiliate WCAX. by illegally entering Canada minutes before the changes come into force, which limit opportunities for some asylum seekers like them. The family was in such a rush to get to Canada before the new guidelines that they left their luggage on the US side of the border, WCAX reported.

From 12:01 a.m. Saturday, asylum-seeking immigrants risked rapid deportation to the United States if they entered Canada illegally, unless they qualified for the exceptions listed in the Revised Safe Third Country Agreement, or STCA . The WCAX video also shows Canadian authorities at midnight unfurling the signs warning people of the new risks of crossing illegally from Saturday.

The treaty, signed in 2002, applies to people who have transited through a country where they could have applied for asylum because it is considered safe, as the name of the agreement suggests. It is in effect at ports of entry, and persons entering a land port of entry may not be eligible to file a claim and be returned to the United States.

A loophole in the agreement included an incentive to use the irregular border crossing at Roxham Road, a remote street that connects Champlain, New York, to Hemmingford, Quebec. Trudeau faces a nationwide pushback for hundreds of immigrants crossing the street and the changes to the agreement mark a significant change in how Canada accepts asylum seekers.

But Roxham Road is not an official crossing, which means that people using it can still seek protection in Canada even if they have passed through the United States. Crossings between ports of entry were not initially included in the deal due to limitations on information sharing, experts say, prompting Canada to try to close that loophole now that those limitations have been modified.

Some asylum seekers risk being rejected

An elected official from nearby Plattsburgh, New York, has raised questions about what could happen to asylum seekers who continue to enter Canada illegally only to be removed under new STCA provisions. .

“Now, with the change in direction between our two countries, there is certainly concern about the impact as people assess whether or not they are approaching the border,” Michael Cashman told CNN on Saturday, Plattsburgh City Supervisor.

“We are about 20 minutes from the Canadian border. We have received no direct communication from federal agencies,” added Cashman, who visited the Roxham Road junction on Saturday.

As they begin to turn away immigrants on Roxham Road this weekend, Cashman and his defenders north of the border in Montreal are watching closely for any possible long-term impact that may come from this Biden-Trudeau deal. Friday.

The U.S. Border Patrol also recently saw a record number of immigrant crossings into the United States from Canada, prompting the agency to send additional authorities to the area to help.

He Swanton Sectorwhich covers approximately 62,000 square kilometers (about 24,000 sq mi) along the Canada-US border, has fewer personnel than areas along the southern US border and has been overwhelmed due to increased border crossings.
